Terms of Service

These Terms of Service ("Terms") govern your use of the ProfitFinder application ("the App") provided by NerdLabs ("we," "us," or "our"). By installing or using ProfitFinder, you agree to these Terms.

1. Service Description

ProfitFinder is a Shopify application that provides profit analytics, ad spend tracking, and financial reporting for Shopify merchants. The App integrates with Shopify, Google Ads, and Meta (Facebook/Instagram) to aggregate data and calculate profit metrics.

2. Account and Eligibility

• You must have an active Shopify store to use ProfitFinder.
• You must have the authority to grant ProfitFinder access to your Shopify store and any connected ad accounts.
• You are responsible for maintaining the security of your account and connected integrations.

3. Pricing and Billing

• ProfitFinder costs $14.99 per month, billed through Shopify's billing system.
• A 14-day free trial is available for new installations.
• You will not be charged until the trial period ends.
• You may cancel at any time through your Shopify admin. Cancellation takes effect at the end of the current billing period.
• We reserve the right to change pricing with 30 days' notice.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract source code from the App
• Use automated systems to scrape or extract data from the App beyond normal use
• Resell, sublicense, or redistribute access to the App
• Interfere with or disrupt the App's infrastructure

5. Data and Privacy

Your use of ProfitFinder is also governed by our Privacy Policy. By using the App, you consent to the collection and use of data as described therein.

You retain ownership of all your store data. We claim no ownership rights over your data.

6. Third-Party Integrations

ProfitFinder integrates with third-party services including Google Ads and Meta. Your use of these integrations is also subject to:

• Meta Terms of Service
• Shopify Terms of Service

We are not responsible for the availability, accuracy, or policies of third-party services.

7. Accuracy of Data

ProfitFinder aggregates data from multiple sources to provide profit estimates. While we strive for accuracy:

• Profit calculations depend on the accuracy of data you provide (e.g., COGS) and data from connected platforms.
• The App provides estimates and analytics, not certified financial statements.
• You should not rely solely on ProfitFinder for tax, accounting, or legal financial decisions.

8. Limitation of Liability

To the maximum extent permitted by law:

• ProfitFinder is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
• We are not liable for business decisions made based on data displayed in the App.

9. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to notify you of planned downtime.

10. Termination

• You may terminate your use at any time by uninstalling the App from your Shopify store.
• We may suspend or terminate your access if you violate these Terms.
• Upon termination, your data will be deleted within 30 days per our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance. We will notify you of material changes via the App or email.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through good-faith negotiation first, then binding arbitration if necessary.
