These Terms of Service ("Terms") govern your use of ProfitFinder, a Shopify application operated by NerdLabs ("we", "our", or "us"). By installing or using ProfitFinder, you agree to these Terms.

1. Description of Service

ProfitFinder is a profit analytics application for Shopify stores. We provide:

• Real-time profit tracking and calculations
• Product performance analytics
• Marketing attribution tracking
• Automated insights and recommendations

2. Account Requirements

To use ProfitFinder, you must:

• Have an active Shopify store
• Be at least 18 years old or the age of majority in your jurisdiction
• Provide accurate information during installation
• Maintain the security of your Shopify account

3. Subscription and Billing

ProfitFinder is billed monthly at $14.99 USD through Shopify's billing system. By subscribing, you authorize Shopify to charge this amount to your payment method on file.

• Free Trial: New users receive a 14-day free trial with full access to all features.
• Billing Cycle: Subscriptions are billed every 30 days.
• Cancellation: You may cancel at any time by uninstalling the app. No refunds are provided for partial billing periods.
• Price Changes: We will notify you at least 30 days before any price increases.

4. Acceptable Use

You agree not to:

• Use ProfitFinder for any illegal purpose
• Attempt to reverse engineer, decompile, or hack the application
• Share your account access with unauthorized parties
• Interfere with the operation of our services
• Use automated scripts to access our services beyond normal app usage
• Resell or redistribute our services without permission

5. Data and Privacy

Your use of ProfitFinder is also governed by our Privacy Policy. By using our service, you consent to our collection and use of data as described in that policy.

6. Accuracy of Calculations

ProfitFinder provides profit calculations based on the data you provide and data we retrieve from Shopify and connected platforms. While we strive for accuracy:

• Calculations depend on the accuracy of your COGS and expense inputs
• We are not responsible for business decisions made based on our calculations
• You should verify important financial data with your accountant
• Attribution data may not capture 100% of conversions due to technical limitations

7. Third-Party Integrations

ProfitFinder integrates with third-party services including Facebook Ads and Google Ads. These integrations are subject to those platforms' terms of service. We are not responsible for changes to third-party APIs that may affect our service.

8. Intellectual Property

ProfitFinder, including its design, code, and content, is owned by NerdLabs and protected by intellectual property laws. You may not copy, modify, or distribute our application without permission.

9. Limitation of Liability

To the maximum extent permitted by law:

• ProfitFinder is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not responsible for lost profits, data loss, or business interruption

10. Indemnification

You agree to indemnify and hold harmless NerdLabs from any claims, damages, or expenses arising from your use of ProfitFinder or violation of these Terms.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will attempt to notify you of planned downtime when possible.

12. Termination

We may suspend or terminate your access to ProfitFinder if you violate these Terms or for any reason with 30 days notice. You may terminate by uninstalling the app at any time.

13. Changes to Terms

We may update these Terms from time to time. Continued use of ProfitFinder after changes constitutes acceptance of the new Terms. We will notify you of material changes via email or in-app notification.

14. Governing Law

These Terms are governed by the laws of the State of California, United States. Any disputes will be resolved in the courts of California.
